New Hampshire Attorney General John Formella is urging the U.S. Supreme Court to uphold laws that bar transgender girls from competing in girls’ school sports.
Formella joined 25 other Republican attorneys general in an amicus brief supporting a West Virginia law under review by the court.
A federal appeals court previously ruled that the law violated a middle school student’s right under Title IX, which protects against sex discrimination.
However, Formella and the other attorneys general argue that Title IX only prohibits discrimination based on biological sex, not gender identity.
New Hampshire has a similar law in place.
