Don Davis, NC-01, was the only member in the US House of Representatives to vote “present” on legislation passed Tuesday that would require school sports to recognize a student’s sex based solely on physical biology.<br>The Protection of Women and Girls in Sports Act of 2025 <a href="https://www.congress.gov/bill/119th-congress/house-bill/28">bill</a> <meta charset="utf-8">passed in a 218-206 <a href="https://clerk.house.gov/evs/2025/roll012.xml#P">vote</a> largely along party lines, though two Texas Democrats approved of the measure with House Republicans. <br>The rule aims to clarify that Title IX is based solely on biological sex at birth, something the <a href="https://www.carolinajournal.com/nc-only-southern-state-to-adopt-bidens-title-ix-gender-rules/">Biden administration has attempted</a> to revise. Title IX was initially implemented in 1972 to protect individuals from sexual discrimination in educational institutions receiving federal funds, ensuring women’s sports opportunities and fairness.<br>The bill would also make it a violation for a recipient of federal funding who facilitates an athletic program to allow a male to participate in an athletic program or activity that is designated for biological women or girls.<br>While every Republican representing North Carolina in the House of Representatives voted in favor of the bill, three of the four Democrats representing North Carolina voted against the legislation. <br>“It’s interesting that Davis refused to follow the party line with a ‘no’ vote, though his “It’s interesting that Davis refused to follow the party line with a ‘no’ vote, though his unwillingness to take a stance one way or the other is unlikely to please partisans on either side of the aisle,” said Mitch Kokai, John Locke Foundation senior political analyst. “Perhaps he remembers the furor he caused within North Carolina’s Democratic Party establishment in 2019, when he voted ‘yes’ along with state Senate Republicans to override a veto of a bill protecting children who survived attempted abortions.”<br>Congressman Pat Harrigan, NC-10, applauded the bill and said leftist policies are erasing opportunities for women and forcing them into an unfair playing field.<br>“Women’s sports were created to ensure fairness, yet today we see that principle being thrown aside,” Harrigan said in a press release. “As the father of two girls, I won’t stand by while those opportunities are erased. Allowing biological males to compete against women not only undermines the integrity of competition but also erases the opportunities women have fought so hard to earn.
